A Technical Authority (TA) is the formally designated government representative responsible for the technical aspects of a contract, system or platform. In Government of Canada contracts, the TA is the person named in the contract who represents the department or agency for which the work is carried out, and who handles matters concerning the technical content of that work.

The role is separate from the Contracting Authority. The Technical Authority specifies and interprets technical requirements and oversees technical performance. Changes to scope, price or legal obligations stay with the Contracting Authority. The term is used across Canadian defence airworthiness, standard federal contract clauses and NATO technical documentation.

How Canadian defence contracts define the Contract Technical Authority

The Department of National Defence (DND) Technical Airworthiness Authority has published an advisory on contract requirements for airworthiness-related in-service support services. It defines the Contract Technical Authority as the person named in the contract who represents the Government of Canada in matters concerning the technical aspects of the work.

The advisory tells DND project management and weapon system management staff to reflect its guidance in requests for proposals and statements of work. It also calls for clauses ensuring that contracted airworthiness-related activities are performed under the authority of the Minister of National Defence and the DND/CAF Airworthiness Program, and that they conform to the Technical Airworthiness Manual (TAM).

Technical Authority versus Technical Airworthiness Authority

The two terms are easy to confuse. The Technical Airworthiness Authority (TAA) is a regulatory role within the Canadian military airworthiness system. It is headed by the Director General Aerospace Equipment Program Management and issues the rules and standards in the TAM. The TAA frequently asked questions describe the Technical Authority as the role that manages design and engineering support for an aeronautical product. That support covers design change control, modifications, maintenance programmes, technical data, configuration management and technical investigations.

In short, the TAA sets the airworthiness rules and the Technical Authority applies them to a specific product or contract. A TAA advisory on civil aircraft operators shows the layering. Airworthiness regulators (TAA, Operational Airworthiness Authority and Airworthiness Investigative Authority) give advice to the Technical Authority, Procurement Authority and Contracting Authority who are seeking to contract those operators.

What a Technical Authority can and cannot do under a contract

Standard Government of Canada solicitation and contract clauses, such as those in this CanadaBuys request for proposals, name the Technical Authority as the representative responsible for the technical content of the work. Technical matters may be discussed with the TA. The clauses also state that the TA has no authority to authorize changes to the scope of the work. Only the Contracting Authority can make those changes, through a formal contract amendment.

Day-to-day administration follows the same split. Contracts commonly require the contractor to send invoices and time sheets to both the Technical Authority and the Contracting Authority. Where a deliverable has deficiencies, a clause may require a remedial plan to go to the Technical Authority for technical review. Any contractual remedy remains with the Contracting Authority.

Federal documents also describe a third role, the Procurement Authority, who gives procurement, contracting and financial advice and helps validate requirements and develop procurement documents. The Technical Authority defines requirements and statements of work, prepares cost estimates and confirms that funding is available.

Platform Technical Authority in NATO usage

NATO uses the term in a closely aligned sense. The NATO Science and Technology Organization report STO-TR-AVT-225 on synthetic jet fuels describes the platform's Technical Authority as the risk owner for the platform. Before fuel containing synthetic components is delivered to a NATO aircraft, clearance documents are provided by the Technical Authority in concert with the Military Type Certificate Holder, the airworthiness authority, the weapon system manager and other officials. The report also offers a decision flowchart to guide the Technical Authority in certifying a platform for a candidate fuel.

What it means for a supplier bidding on Canadian public contracts

Identify the Technical Authority named in the solicitation and treat that person as your source for technical interpretation and direction. Do not treat their instructions as authority to change scope. If a technical direction would alter the work, price or terms, ask for a contract amendment from the Contracting Authority before you proceed. Copy both parties on invoices and time sheets when the contract requires it. On airworthiness-related defence work, expect the Technical Authority to hold you to TAM requirements.
